Agreement and provider
Briana Swords and Hock Ng, jointly operating AssortmentIQ, provide the AssortmentIQ service available at assortmentiq.com (“AssortmentIQ,” “we,” “us,” or “our”). By installing or using AssortmentIQ, you confirm that you are authorized to act for the Shopify merchant and agree to these terms. If you do not agree, do not install or use the service.
Free beta service
AssortmentIQ is currently offered as a free beta. There is no subscription or charge through Shopify during the beta. Beta features can be incomplete, can change, and can be suspended or discontinued. We will provide notice before introducing a paid plan that requires a merchant’s approval.
The service
AssortmentIQ reads authorized Shopify data to produce merchandising dashboards, reports, recommendations, planning tools, and exports. Unless a feature clearly states otherwise and obtains the required Shopify permission, recommendations do not automatically change products, prices, inventory, promotions, purchase orders, or other store data.
Merchant responsibilities
- Maintain a valid Shopify account and provide only access you are authorized to provide.
- Review recommendations, calculations, AI-generated material, and exports before acting on or publishing them.
- Maintain accurate product, inventory, cost, order, and planning data in Shopify and AssortmentIQ.
- Comply with applicable laws, Shopify policies, and obligations to customers and staff.
- Protect account access and promptly report suspected unauthorized use or security incidents.
Recommendations and AI output
Merchandising recommendations and forecasts are decision-support tools, not guarantees of sales, margin, inventory performance, or financial results. AI-assisted output can be inaccurate, incomplete, or unsuitable for a particular store. The merchant remains responsible for business decisions and published content.
Acceptable use
You must not:
- Use AssortmentIQ unlawfully, deceptively, or in violation of another person’s rights.
- Attempt to access another merchant’s information or bypass authentication, authorization, usage limits, or security controls.
- Interfere with the service, introduce malicious code, scrape it at unreasonable volume, or reverse engineer it except where law expressly permits.
- Submit sensitive customer information to free-text or AI-assisted fields when it is not required for the feature.
Merchant data and privacy
You retain your rights in merchant data. You authorize AssortmentIQ to process that data only as needed to provide, secure, support, and improve the service, subject to our Privacy Policy. You are responsible for providing notices and obtaining permissions required for your use of optional storefront analytics.
Ownership
AssortmentIQ and its software, interface, branding, and original materials remain the property of the provider and its licensors. You may use outputs generated for your store for your internal business and merchandising activities, subject to third-party rights and applicable law.
Third-party services
AssortmentIQ depends on services including Shopify, hosting and database providers, and OpenAI for merchant-invoked AI features. Availability can be affected by those providers, and their own terms and privacy practices can apply to their services.
Availability and changes
We aim to operate AssortmentIQ reliably but do not promise uninterrupted or error-free access. We can modify the service to improve security, comply with platform requirements, or develop the beta. We can restrict access when reasonably necessary to protect the service, merchants, Shopify customers, or others.
Disclaimer
To the maximum extent permitted by applicable law, AssortmentIQ is provided “as is” and “as available,” without warranties of merchantability, fitness for a particular purpose, non-infringement, or a particular business result. Nothing in these terms excludes a warranty or right that cannot lawfully be excluded.
Limitation of liability
To the maximum extent permitted by applicable law, Briana Swords and Hock Ng will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, goodwill, or business opportunities arising from the service. Because the beta is free, aggregate liability for claims relating to the beta will not exceed USD $100, except where applicable law does not permit that limitation.
Termination
You can stop using AssortmentIQ and uninstall it at any time. We can suspend or terminate access for material violations of these terms, security risks, legal requirements, Shopify platform requirements, or discontinuation of the beta. Store data is handled after uninstall as described in the Privacy Policy.
Changes to these terms
We can update these terms as the service changes. We will revise the effective date and provide additional notice when required. Continued use after updated terms take effect constitutes acceptance where permitted by law.
